Terms & Conditions

This is the boring but important bit.

Thank you for choosing to buy your food, drink and household goods from us, that is to say with www.veggiesandmore.co.uk, a specialist retail trading division of WestCountry Fruit Sales Ltd.

WestCountry Fruit Sales Ltd is the oldest and largest privately owned supplier of fresh, chilled and ambient food and non-food products to the professional catering sector in Cornwall and Devon.  

The following T’s & C’s explain the terms on which we are able to offer and provide you, the customer, with satisfaction in your transaction with us.  This helps to define your relationship with Veggies & More (V&M) and gives you certainty and confidence in us and in the orders that you place with us. Please read these terms and conditions carefully as they affect your rights and liabilities under the law. 

We reserve the right to review and amend these conditions from time to time.

If you are a consumer (e.g. an individual not acting as a business) there are certain terms implied under your statutory rights which we cannot exclude or limit. It is important for you to know that nothing in our terms and conditions affects your statutory rights. If you would like more information on your rights as a consumer contact your local Citizens Advice Bureau or Trading Standards Office.

1 You.. & your account with us:

1.1 You must be at least 18 years of age (or a business operated by someone at least 18 years of age) to trade with V&M.

1.2 You must ensure that any details you provide are complete and accurate, including your delivery instructions as per 5.3.

1.3 Any change to your delivery or contact details must be notified to us promptly, by calling our customer services team on 01326 331 900.

1.4 We will never keep or store any bank or card details belonging to you, whether in writing or in any digital format, whether on WCFS on site or Cloud data servers. We will require payment from you each time that you complete a purchase from us. We will only accept payment directly from you over the telephone at the time that you confirm the amount that you are to be charged for the goods that you purchase from us. 

1.5 Your account with V&M is not a credit account and payment will be required when your order is processed. 

1.6 You will receive email notification from us as and when you place a paid-for order with us.

1.7 You will receive email notification from us to confirm that your order has been successfully picked and dispatched, on the day of delivery to you.

1.8 The details you provide are governed by our privacy policy which is available here.

1.9 It is your responsibility (at your own cost) to obtain the necessary tools and services (computer, telephone, internet connection etc) to access our online product listing pages (www.veggiesandmore.co.uk) from which you identify/select the items that you wish to order from us.

The information contained in this website is for general information purposes only. The information is provided by V&M and whilst we endeavour to keep the information up-to-date and correct, we make no representations or warranties of any kind, express or implied, about the completeness, accuracy, reliability, suitability or availability with respect to the website or the information, products, services, or related graphics contained on the website for any purpose. Any reliance you place on such information is therefore strictly at your own risk.

In no event will we be liable for any loss or damage including, without limitation, indirect or consequential loss or damage, or any loss or damage whatsoever arising from loss of data or profits arising out of, or in connection with, the use of this website.

Every effort is made to keep the website up and running smoothly. However, V&M takes no responsibility for, and will not be liable for, the website being temporarily unavailable due to technical issues beyond our control. 

The www.veggiesandmore.co.uk website is not an end-to-end transactional website. You can be reassured therefore that at no stage will you be required to enter any payment details of any kind whilst browsing our online product lists to identify your shopping items. All orders are placed, and payments received, via a telephone call to our telesales team (01326 331900).

Cookies help us give you a better experience on our website. Some collect information about browsing and buying patterns. By using and browsing our website, you agree to our use of cookies. If you don't agree, you'll need to disable cookies or, alternatively, refrain from using the site.

What are cookies? Our website uses cookies to collect information. They ‘remember’ when your computer or device accesses this website. They are essential to our website working properly and let you shop with us online. Cookies also tailor the products we sell and how they are advertised to our customers, both on our website and elsewhere.

This information is about the pages you look at, any products you buy and the way you move around the site. What are cookies used for?

1. For technical purposes essential to the effective working of our website. 

2. To let us collect information about the browsing activities of our customers, including monitoring the success of campaigns, competitions etc.

How do I disable cookies? If you want to disable cookies you need to change your website browser settings to reject cookies. How you do this will depend on your browser, so refer to your browser for help.

What happens if I disable cookies? It depends on which cookies you disable, but in general this site may not work properly if you switch cookies off. If you only disable third party cookies you can still buy from our website. If you disable all cookies, you won't be able to buy from our website.

3 Payment

3.1 In order to complete your offline transaction/purchase with us you must ensure that V&M’s telesales representative is supplied with a suitable and agreeable means by which to obtain payment at the time of telephone order placement, i.e. by a current, valid debit card or credit card. 

3.2 Goods can only be dispatched if full payment has been received and cleared by V&M’s nominated card payment processing contractor. Confirmation that this payment process has been completed successfully should ordinarily take place during the course of you making your card ‘payment’ with us over the telephone. We cannot however accept any liability for how long it takes the banks to process your card payment.

3.3 We reserve the right to cancel your order (cancel delivery in full) if there is any payment problem resulting in your payment to us being withheld or withdrawn. 

Alcohol T&C
4 Ordering & Purchasing

4.1 You must be over the age of eighteen to purchase alcohol from V&M. If you have ordered alcohol from us and cannot be at home to take receipt of your delivery, it is your responsibility to ensure that a suitable person aged eighteen or older is there to receive the order. Anyone who appears to be under the age of 21 may be asked for proof of age and where such proof cannot be provided at the point of delivery V&M reserves the right to refuse delivery of alcohol. Such refusals will be credited in full, however, we will bear no liability for such refusal. 

4.2 Orders placed with V&M that are for delivery are subject to a minimum basket value/spend of £35 for main orders (refer to our order thresholds on our Delivery and FAQ pages). Orders may be accepted of a lower value but they may only be for collection (within the collection window of 1pm to 4pm) from one of our three strategically located depots in Cornwall and Devon. V&M reserves the right to alter the existing, or introduce new minimum spend conditions which will be published our website.

4.3 Delivery Charges. Collection from our depot is free for any value of goods.

Order values £35 to £49 = £5.00 delivery charge

Order values £50 to £99 = £3.50 delivery charge

Order values over £100 = FREE delivery

FREE delivery is available on repeat orders placed within 7 days for order values over £50.

This charge is VAT incl.

4.4  While we will endeavour to deliver all accepted orders, our products are subject to availability and we do not always know if a product is, or will be, available for delivery at the time of accepting an order. If we are unable to deliver an item you have ordered we may offer a reasonable substitute. You may reject this substitute and you will not be charged for it, or where payment has already been taken you will be refunded any amount paid for that item. Where we do not offer a substitute product the item will be removed from your order and again you will not be charged for it, or where payment has already been taken you will be refunded any amount paid for that item. We will bear no liability for the unavailability of our products.

4.5 Seasonality and pricing. Many of the fresh produce lines that we offer are subject to variations in seasonal availability and supply price. Please note that both our veg box contents and our general list of fresh produce is subject to continuous change. You accept that the price to be paid for all items in your order will be that quoted to you at the time and on the day that you place the order over the telephone with V&M. The telesales handler will offer you the opportunity to hear a verbal review of your order, item by item, providing you with the product description and price for each item for you to confirm. 

4.6 Where an item may on occasion be mistakenly displayed on our website product listings with an incorrect price listing, the firm price quoted to you verbally and subsequently reviewed and confirmed on the day of your telephone order placement will be the overriding default price for the product on the day. 

4.7 All prices displayed on the website are inclusive of any applicable taxes and duty (including VAT).

4.8 Some of our products are priced by weight (for example, some fresh produce items). We show the prices for weights by the kilo on the website. We will typically sell and invoice all weighed products by the whole kg. Nevertheless, you will always receive at least the kilo weight charged for and in many instances more than the kilo weight and never less than. 

4.9 You are entitled to cancel payment for products where there has been fraudulent use of your payment card (despite the above provisions). Where a fraudulent payment has already been made then you should contact your card issuer for credit back to your card.

4.10 V&M is a B2C (business to consumer) enterprise. V&M’s primarily purpose is to sell to consumers. You must not resell any products ordered from us without our knowledge and consent. 

4.11 Calls to and from customer services and payment team may be recorded for training purposes.

5 Delivery & delivery instructions

5.1 We will deliver to the address that you give to us at the time of order placement. stated in your V&M account (herein also referred to as “home”).

5.2 We reserve the right not to deliver to all locations, or not to deliver all products to all locations. You will be notified during the account creation process if we are unable to deliver to your address. 

5.3 V&M’s telesales and transport management teams, as well as V&M’s delivery drivers, will be utilising the super-accurate What3Words geolocation App to identify the precise location that our customers require goods to be deposited. This is a far more powerful geolocation tool than a postcode (which we also need to capture). It will make our drivers’ job a lot easier and lead to less frustration and time loss, for both parties, at the point of delivery. What3Words can be found online or by downloading the App on your phone or you can go to their website to use their 3m x 3m location tool. The technology is free to use. This amazing technology breaks the entire planet’s surface down into 3m x 3m uniquely named cells.. each with a unique identifier being a combination of 3 pre-assigned words for every 3m x 3m cell. Ideally we want each customer to be able to tell us what their precise What3Words delivery ‘drop and go’ location is at their premises. You will be able to use this ‘simple to use’ but powerful location identifying technology to let us know the exact door location (for instance) at the back of the house or of the shed/garage/greenhouse that you would like V&M delivery driver to place the products.. in the event that you are not there to receive. Once we have the relevant What3Word geolocation then we can ensure that the delivery is left in exactly the correct location at your desired delivery address.

5.4 Delivery specifics. V&M is able to deliver an order and have the goods received in person by the customer, or we are equally happy to deliver the goods to the address and detailed drop location provided - without the customer needing to be there in person to receive the order. V&M cannot make more than 1 attempt to deliver the goods ordered and it is therefore vitally important that you provide V&M’s telesales account manager with the precise location/description (What3Words please) of the designated ‘drop and go’ point, a the time of order placement. By providing us with a ‘drop and go’ address/location that enables V&M to deliver your goods even when you are not at home to take receipt of the goods, you are acknowledging responsibility for safe ownership of those goods from the point at which the goods are delivered to your designated location. This forms part of our contract under these terms and conditions. If we are delivering fresh, perishable produce to you on a ‘drop and go’ basis, it is important that you make provision for the fact that some of the goods will need to be placed in a cool, ideally refrigerated environment at the earliest opportunity in order to maintain the produce in good condition, or at the very least to provide an environment in which the produce can be temporarily stored at a temperature not exceeding 8 degC until such a time as you are able to fully refrigerate them to below 5 deg C.

5.5 Once your delivery instructions have been followed and completed by us, you will accept that you are in possession of the delivered goods. Where the delivery instructions have been followed; we will not accept any liability for damage to, or theft of your goods, nor will we accept any liability for any incidents which may arise as a result of the theft or damage to such goods (including alcohol). 

5.6 Your order will be delivered to your delivery address on the confirmed date detailed in the emailed order confirmation that you are sent at the time of order placement. V&M’s delivery window is a full working day slot of 7am – 7pm. If you make a request for the delivery to be within a narrower 6 hour window we will always endeavour to accommodate your preference. However the actual time of delivery will be determined on the delivery day by the logistical complexity and volumes to be serviced as well as the familiar variables that can materially affect logistics efficiency including, but not limited to: traffic, weather and mechanical breakdown. If ordering regularly, you may notice that your delivery occurs at a similar time on a number of those delivery days, however, we make no guarantee of this time and accept no liability for inconvenience or loss as a result of a deviation from it.

5.7 We cannot accept liability for any inconvenience or loss where we are unable to deliver to you for reasons beyond our control (e.g. adverse weather, vehicle breakdown, traffic congestion, strike actions, supplier failures). We will of course refund you for any part of your order which is not delivered or which has been compromised as a result of the delay.

5.8 You must inspect your goods as swiftly as possible after delivery and notify us promptly of any errors. We will refund you for any products you receive that were not ordered, are faulty, have been substituted with a product that is unacceptable to you or that were delivered without us following these terms and conditions. However, such liability will be limited to the value of the erroneous and/or undelivered goods.

5.9 Delivery Schedule. V&M deliver throughout Cornwall and South Devon 6 days a week, Monday - Saturday inclusive, 52 weeks of the year, with the exception of Xmas Day, Boxing Day and New Year’s Day.  Orders for Monday delivery must be made by 5pm the preceding Friday. All other orders for delivery on Tuesdays - Saturdays enjoy an order cut-off/deadline of 5pm the previous day. Minimum order value for delivered goods is £35 (excl delivery charge of £7.50 or for orders over £50 a delivery charge of £6.00). Free delivery for goods totalling £100 or more. V&M reserves the right to amend this delivery schedule at any time and without notice. Confirmation of the delivery day availability and any changes to this core schedule will be made clear at the time of telephone order placement.  

6 Cancellation

You can cancel your order by phone to our telesales account managers during the hours of 8am to 5pm, Monday to Friday. Cancellations made more than 48 hours before the day of delivery can be made free of charge. For cancellations within 48 hours of the delivery date, V&M reserves the right to charge a combined administration and goods consolidation/preparation/handling charge as detailed below: 

£5 cancellation charge for orders up to £50 in value

£10 for orders £50-100 in value

£20 for orders over £100 in value

7 Warranties & applicable law

7.1 We guarantee that our products will be of a satisfactory condition and quality (with the exception of defects caused by your mis-use, neglect or by accidents while the goods were in your possession). Please notify us if you are dissatisfied with any of our products. If upon examination they are defective or faulty we will gladly refund you the price paid for them.

7.2 We accept no liability in relation to representation, including unforeseeable losses, and losses to a business (loss of reputation, profits, trade or trade opportunities).

7.3 Our entire liability under these terms and conditions will not exceed the purchase price of the goods in question. Also, nothing in these terms and conditions can limit our liability to your death or personal injury resulting from our negligence or that of our employees, agents or subcontractors.

7.4 We shall not be liable for any delay or failure in the performance of our obligations due to events beyond our reasonable control such as but not limited to fire, adverse weather, acts of God, strikes, labour disputes, civil unrest, accident, disruption to energy supplies, equipment or supplier failure, road traffic problems, disease, terrorism or war.

7.5 You are not entitled to assign, sub-license or otherwise transfer any of your rights under these terms and conditions.

7.6 These terms and conditions are governed by and construed in accordance with British law and the British courts will have no-exclusive jurisdiction over any disputes which arise in relation to these terms and conditions.

7.7 If any of the provisions in these terms and conditions are found to be invalid by a court having jurisdiction, then the invalidity of that provision will not affect the validity of any other provisions within these terms and conditions.
